Legal Contract Writer Required - Long Term Project - Excellent Pay For The Best Freelancer.

Hi, I am new to Freelancer so please accept my apologies if i do not follow the normal process.

We are a printing group planning to expand and start a new publishing arm in the fiction book market both in actual print as well as e-format.

I will be heading this new division and as such am starting from new.

Previous to this we were commissioned printers for the material and this was directly for publishers and authors.

I have no knowledge or experience of the legal rulings in this field.

However as a printing firm, we have seen alot of things happen in the publishing world and am well aware of how intense disputes can arise between authors and publishers and so by having a legal expert on our team, am wanting to ensure it never is an issue to ourselves.

We require an expert legal contract writer who we would want to work with us for a few hours every week for approximately a year.

Some weeks it may simply be for a few hours and other weeks it may be more.

All work will be done virtually (online or via Skype) - so location is NOT an issue, and so you can fit this in with your other commitments - we are relaxed with our terms and conditions.

We have many tasks to have undertaken but i will only list one task below, as its a trial task to see who we can find that fits the role and we feel comfortable with.

Task 1:

Draft a contract whereby it covers EVERY ONE ISSUE in favour of us (ie the new publishing company)

We are planning to hire a few authors (some new and some with existing books that have not been published) whereby they will simply be given a fee and they agree to hand the book and the entire copyrights to it to us i.e the new publishing company we are establishing.

Terms that we would want covered are on a global basis.

[login to view URL] Complete confidentiality as to authorship. (We may not want to publish the author name to ensure they are not poached by other publishers)

In essence giving us complete ownership in every way to the authored work in exchange for a fee.

[login to view URL] areas that we would require is for the author / employee to NOT engage with any other company without our permission , in any matter connected to us i.e. if they write for others the ask for our permission first as the last thing we want is to invest in building up an author and then once they have a following for them to move to another publisher.

5.A further area expected to be covered would be the author/employee not engaging in any activity that is linked to our company with any other company without our permission i.e. doing a review on radio concerning the books etc

I have only listed 5 points above however i will CLEARLY STATE i expect you to have many many more points than this.

A simple google search allows you to find a great deal of contractual points.

So please do NOT do a half hearted job.

I have obtained draft contracts from local law firms which I am going to use to compare with the contracts you devise in order to select the best freelancer.

The key in selecting a legal expert is to see how FAR and WIDE the contract can go in protecting our interests. If you sit back and imagine you were in my position whereby you would invest in authors and you would want to protect your investment fully, how would you devise the contract???

This is the first task.

Expert legal practitioners will probably use a standard template they have on file - And i do not mind this as i understand they will simply add a few points.

Its a very quick task to allow me to locate the best freelancer.

Apologies for making this addition to the description above, but as i have had a great deal of messages as well as draft contracts sent to me, I would like to clarify a few points.
The publishing arm we intend to set up will be very honest and very straight in all our terms, No author will be compelled to agree to the contract, however our aim is to lay out all our terms and conditions very clearly (A term will be required to be inserted where it covers the principle of "Unconscionability") , in the hope of no dispute ever arising and it is for this reason i would request all freelancers to also consider the points below in addition to the ones initially posted in the description above.
Point 1:
As a publishing group I will be signing existing authors as well as absolute beginners in writing , and these persons are those whom will be funded for a period of years by us through undertaking writing courses to allow them to become authors - this will be seen as an investment by us.
After thinking things through and discussing this matter with a few authors who are planning to sign with us - I want to point out that the decision has been made that the authorship of every book we publish will be kept absolutely confidential. This means the legal contract has to clearly include this term whereby the author hands all the work in every way to us, and discharges their duty of any recognition/credit and even mere mention of being the author and as such then agrees to maintain absolute silence on the matter. This will include the author no longer being seen as the author of the piece as it will be listed as having been authored by the Publishing Group.
It also is expected that all authors signed with us , in no way whatsoever are permitted to have any claim of authorship in the hope of attracting other publishers (i.e. if we agree to purchase a set amount of works by an author, works which have not been touched by other publishers, and if we as a publishing group are brave enough to take such a risk as in trusting in an author, we as a publishing group also expect to become the complete owners of the work in every way and we will not be wanting to see authors updating their CV`s as having published 10 books with us or so i.e. claimants to be widely published etc)

Point 2:
We plan to send many of the writers at the beginning stages on the path to becoming authors, on writing courses to improve their skillbase and develop the art of writing for us. We would want a clause inserted in the contract which prohibits all authors from teaching such courses (i.e. if we fund an author to go on an array of writing courses and they publish many books with us, the last thing we want is to see the very same author then advertising themselves to be training providers on how to become authors or conducting courses on how to write creatively while using their record of having published with our company as an attracting point to gain custom). This is unless we permitted them to do so, and hence prior permission would be sought outright by them.

Point 3:
All submissions made to me are to be original - Do NOT use a generic off the shelf agreement, or off the internet search agreement - if you choose to use that as a foundation then the very least you can do, is tweak the document it in every way to ensure it covers all areas for me.

I should point out i am expecting every submission by freelancers to be very encompassing i.e. this first task that has been set as something where i can identify the vision of the legal expertise held by you.
